Service Description
Iowa Pest Control provides professional pest management and wildlife control services to residential, commercial, and agricultural clients throughout the state of Iowa. Our services include, but are not limited to, inspection and identification of pest infestations, treatment applications for insects and rodents, termite control and monitoring, bed bug elimination, mosquito reduction programs, exclusion services for wildlife such as bats, raccoons, and squirrels, and ongoing maintenance plans. All service appointments are scheduled based on availability, and specific treatment methods are selected at the discretion of our licensed technicians based on site conditions, pest species, environmental factors, and applicable regulations. We utilize integrated pest management principles and may employ chemical, mechanical, biological, or cultural control strategies as appropriate. Service details, including frequency of visits, covered pests, and treatment areas, are specified in individual service agreements or work orders. Weather conditions, property accessibility, and cooperation from the property owner may affect service delivery and outcomes.
No Guarantee or Warranty
Iowa Pest Control does not guarantee the complete elimination or permanent prevention of any pest species. Pest behavior, biology, and environmental conditions vary and are beyond our absolute control. Results may differ based on factors including, but not limited to, severity of infestation, structural conditions of the property, adjacent properties and land use, climate and seasonal variations, and adherence to preparation and post-treatment instructions. Any warranties or guarantees expressly offered in a separate written service agreement shall be limited to the specific terms, timeframe, and conditions stated therein. We do not warrant that our services will prevent future infestations, nor do we guarantee that treated structures will remain free of pests indefinitely. Re-infestation from external sources is possible and does not indicate failure of services rendered.
User Responsibilities
Clients must provide accurate and complete information regarding pest issues, property conditions, prior treatments, and any health concerns or sensitivities of occupants, including pets. You must ensure safe access to all areas requiring treatment and secure or remove pets, children, and sensitive items as directed by our technicians. Failure to follow pre-treatment and post-treatment instructions may reduce effectiveness and void any service guarantees. You are responsible for maintaining structural integrity, addressing moisture issues, and implementing sanitation and exclusion recommendations provided by our technicians. You must notify us within the specified timeframe if pest activity persists or if adverse conditions occur following treatment. Payment is due according to the terms of your service agreement. Cancellation of scheduled appointments without adequate notice may result in fees. You represent that you have authority to authorize services for the property in question.
Limitation of Liability
To the maximum extent permitted by law, Iowa Pest Control and its employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, loss of use, business interruption, or personal injury, except where caused by our gross negligence or willful misconduct. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the event. We are not liable for damage to personal property, landscaping, or structures that are not reasonably visible or accessible at the time of service, or for pre-existing conditions that are concealed or undisclosed. You agree to hold harmless Iowa Pest Control from claims arising from your failure to follow instructions or from conditions beyond our reasonable control.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on Iowa Pest Control's website, marketing materials, and documentation are the exclusive property of Iowa Pest Control or its licensors. This includes, without limitation, service descriptions, technical data, photographs, graphics, written content, and software. You may not reproduce, distribute, modify, create derivative works from, or exploit any such materials without prior written consent. Any feedback, suggestions, or testimonials you provide may be used by Iowa Pest Control for marketing and promotional purposes without compensation. Our service marks and business name represent significant goodwill and may not be used in any manner likely to cause confusion or dilution. Unauthorized use of our intellectual property may result in legal action.
Governing Law
These Terms of Service and any disputes arising from or relating to services provided by Iowa Pest Control shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Iowa, and you consent to the jurisdiction and venue of such courts. You waive any objection to this venue on the basis of forum non conveniens or any similar doctrine. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision is held invalid or unenforceable under Iowa law, the remaining provisions shall continue in full force and effect.
Changes to Terms
Iowa Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or upon notification through other reasonable means. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. Material changes to terms affecting pricing, liability limitations, or dispute resolution procedures may, at our discretion, be communicated directly to active clients prior to their next scheduled service. The effective date at the top of this document indicates when the current terms were last revised. Previous versions may be available upon request.
